• Not be prohibited from using our Services under applicable laws
• Reside in a country where our Services are available
• Provide accurate, complete, and current information during registration

We reserve the right to refuse service to anyone for any reason at any time, subject to applicable laws.

3.1 Account Creation

To access certain features of our Services, you must create an account. During registration, you agree to:

3.2 Identity Verification

You are responsible for all activities that occur under your account. We recommend enabling two-factor authentication and using a strong, unique password. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

4.1 Money Transfer Services

We provide international money transfer services that allow you to send and receive money across borders. Exchange rates and fees are clearly displayed before you confirm any transaction.

4.2 Fees and Exchange Rates

• All fees are disclosed upfront before you complete a transaction
• Exchange rates may fluctuate and are locked in at the time of transaction confirmation
• We do not charge hidden fees or markup on exchange rates
• Third-party fees (such as intermediary bank fees) may apply and are outside our control

4.3 Transaction Limits

Transaction limits apply based on your account verification level, jurisdiction, and regulatory requirements. These limits are displayed in your account dashboard and may be adjusted based on your transaction history and risk profile.

You agree not to use our Services for any unlawful or prohibited purposes, including but not limited to:

• Money laundering or terrorist financing
• Fraudulent activities or scams
• Violations of sanctions or export control laws
• Transactions involving illegal goods or services
• Circumventing our security measures or authentication procedures
• Impersonating another person or entity
• Interfering with or disrupting our Services
• Using our Services in a manner that could damage, disable, or impair our systems

We reserve the right to investigate and take appropriate action against anyone who violates these Terms, including reporting to law enforcement authorities.

Spearheadpay complies with all applicable anti-money laundering (AML), counter-terrorist financing (CTF), and know-your-customer (KYC) regulations. You acknowledge that:

• We may request additional information or documentation at any time
• We may delay, block, or refuse any transaction that we believe may violate applicable laws
• We may report suspicious activities to relevant authorities
• We cooperate with law enforcement and regulatory agencies as required by law

Once a transaction is confirmed and processed, it generally cannot be cancelled. However, you may request a cancellation or refund in the following circumstances:

• The transaction has not yet been processed
• There was an error in the transaction details
• The recipient has not claimed the funds (for cash pickup services)

Refund requests are subject to our review and approval. Refunds may take 5-10 business days to process and may be subject to fees depending on the payment method and transaction status.

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Spearheadpay or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Services without our express written permission.

To the maximum extent permitted by law, Spearheadpay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of our Services.

Our total liability to you for all claims arising out of or related to these Terms or our Services shall not exceed the amount of fees paid by you to us in the twelve months preceding the claim.

Any disputes arising from these Terms or our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

Before initiating arbitration, you agree to first contact us to attempt to resolve the dispute informally.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our Services after such changes constitutes your acceptance of the new Terms.
